If you are selling products in the USA, typically you would need this cover.
The US legal system is very different to the UK’s, with higher compensation awards and significantly higher legal costs. Claims can arise unexpectedly and defending them can be extremely expensive without the correct insurance in place.

In most cases, no.

Unless your UK policy specifically includes the USA and Canada, it will not protect you. Many policies automatically exclude these territories. It’s essential to ensure you have the correct territorial and jurisdictional cover.

Selling through online marketplaces such as Amazon often means your products will be shipped to customers in the USA. When you reach Amazon’s current threshold of $10,000 in monthly sales, you must have Product Liability Insurance that meets Amazon’s requirements. Even if you fall below that threshold, having the correct cover in place is still essential.

We deal with Amazon’s insurance requirements every day, including wording such as “Amazon.com Services LLC and its affiliates and assignees” being added as Additional Insureds, specific limits of indemnity, and the format of proof Amazon expects.

Understanding Key US Insurance Terminology

The terminology used in US insurance can differ significantly from UK standards. Some terms you may encounter include:

Vendors Extension

Commonly required in the USA and Canada, this allows a customer or distributor to be named on your policy. It offers very specific protection for them if something goes wrong with your product.

Dual Insured

Some US companies request to be named as a Dual Insured. This is generally avoided by UK insurers, but there are exceptions, particularly for Amazon FBA, where specialist insurers can provide the necessary wording.

Hold Harmless Agreements

These are typical in the USA. They can shift additional liability onto your business through contractual terms. We work with underwriters who understand these agreements and can structure insurance accordingly.

ACORD Forms

Often requested by US customers, an ACORD form summarises all the cover under your policy. Your insurance schedule or certificate contains the same information, but we can provide ACORD documentation where required.
