How We Can Help
USA Product Liability insurance is designed for UK manufacturers, distributors, and online retailers who sell in the USA, including Amazon FBA businesses. Even if you’re simply retailing products online, you can face many of the same risks as a manufacturer.
This type of insurance protects you when a product is alleged to have caused damage, injury, or financial loss. It typically includes the cost of defending a claim and, where applicable, paying compensation if the allegation is proven.
Many UK businesses find it difficult to obtain this cover, as litigation in the USA and Canada can be significantly more expensive than in the UK. Most mainstream UK insurers either exclude the USA and Canada entirely or only offer limited cover where turnover in those markets is very small.
That’s where we can help. With extensive experience in this specialist area, we work with insurers who understand the North American market and are willing to insure businesses exporting there. These insurers can also provide specialist extensions such as Vendors’ Coverage or Dual Insured wording where required by Amazon.

Why Choose Us
Your Questions, Answered
If you are selling products in the USA, typically you would need this cover.
The US legal system is very different to the UK’s, with higher compensation awards and significantly higher legal costs. Claims can arise unexpectedly and defending them can be extremely expensive without the correct insurance in place.
In most cases, no.
Unless your UK policy specifically includes the USA and Canada, it will not protect you. Many policies automatically exclude these territories. It’s essential to ensure you have the correct territorial and jurisdictional cover.
At Brown & Brown Mansfield, we can arrange the right liability insurance for US exports, whether only a small percentage of your turnover goes to the USA or 100%.
Selling through online marketplaces such as Amazon often means your products will be shipped to customers in the USA. When you reach Amazon’s current threshold of $10,000 in monthly sales, you must have Product Liability Insurance that meets Amazon’s requirements. Even if you fall below that threshold, having the correct cover in place is still essential.
We deal with Amazon’s insurance requirements every day, including wording such as “Amazon.com Services LLC and its affiliates and assignees” being added as Additional Insureds, specific limits of indemnity, and the format of proof Amazon expects.
At Brown & Brown Mansfield (previously Real Insurance Group), Amazon Seller Insurance is one of our specialist areas. Whether you need liability insurance for the USA and Canada, marine cover to transport your goods, or insurance for stock held in fulfilment centres, we can arrange the protection you need.
Some products are more challenging to insure. In higher risk cases, insurers may provide only a percentage of the required cover, and we may build a solution using multiple insurers to achieve 100% of the protection you need.
With many years of experience, our Mansfield office have placed cover for a wide range of manufacturers and exporters, including industrial machinery, automotive components, food and drink, cosmetics, and many other specialist products. We also insure businesses whose goods never even enter the UK, such as products shipped directly from the Far East to the USA.
Understanding Key US Insurance Terminology
The terminology used in US insurance can differ significantly from UK standards. Some terms you may encounter include:
Vendors Extension
Dual Insured
Hold Harmless Agreements
ACORD Forms
What Can Go Wrong?
Examples include:
- A bottle breaking and spilling its contents, causing injury
- A component malfunctioning and causing property damage
- An instruction manual containing an error that leads to improper use
- A translation error from a supplier resulting in misleading or incorrect directions
Liability is not always about the product itself and in some cases documentation, instructions, packaging and labelling can all contribute to a claim.
In the USA, where litigation is more prevalent and legal costs significantly higher, the financial impact can be substantial even if you think you are not at fault.
Product Liability Insurance protects your business by covering legal defence costs and, if necessary and appropriate, compensation awarded as a result of injury, loss or damage caused by your product.
