{"id":1602,"date":"2022-02-03T14:03:46","date_gmt":"2022-02-03T20:03:46","guid":{"rendered":"https:\/\/www.bbrown.com\/?post_type=insight&#038;p=1602"},"modified":"2023-04-25T16:02:22","modified_gmt":"2023-04-25T21:02:22","slug":"new-oklahoma-law-affects-qualified-status-of-hdhps-for-hsa-eligibility","status":"publish","type":"insight","link":"https:\/\/www.bbrown.com\/us\/insight\/new-oklahoma-law-affects-qualified-status-of-hdhps-for-hsa-eligibility\/","title":{"rendered":"New Oklahoma Law Affects Qualified Status of HDHPs for HSA Eligibility"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row row_style=&#8221;page-hero&#8221; full_width=&#8221;stretch_row_content&#8221;][vc_column]\n\t<div class=\"hero hero--wrap    \">\n\n\t\t<div class=\"hero--background-image hero--background-image-blur\">\n\t\t\t<div class=\"hero--overlay\"><\/div>\n\t\t\t\t\t\t\t<div class=\"hero-background\" style=\"background: url(https:\/\/www.bbrown.com\/wp-content\/uploads\/2022\/01\/AdobeStock_181650311-1-scaled.jpeg) center center no-repeat; background-size: cover;\"><\/div>\n\t\t\t\t\t<\/div>\n\n\t\t<div class=\"hero--container\">\n\t\t\t<div class=\"container\">\n\t\t\t\t<div class=\"hero--inner width-100\">\n\n\t\t\t\t\t\n  <div class='content-heading  100%  '>\n    <p class='text-white subheading'>Employee Benefits<\/p>\n    <h1 class='text-white    '>\n      New Oklahoma Law Affects Qualified Status of HDHPs for HSA Eligibility\n    <\/h1>\n\t\n  <\/div>\t\t\t\t\t\n\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t<\/div>\n\t\t<\/div>\n\n\t<\/div>\n\n\t\n[\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;2\/3&#8243;]\n  <div class='content-heading  100% content-heading--ruled '>\n    \n    <h1 class='text-brand-dark-blue    h2'>\n      New Oklahoma Law Affects Qualified Status of HDHPs for HSA Eligibility\n    <\/h1>\n\t\n  <\/div>[vc_column_text]Oklahoma recently enacted a law, effective November 1, 2021, which requires health insurers that provide pharmacy benefits and pharmacy benefit managers that administer pharmacy benefits for a health plan \u201cto include any amount paid by an enrollee or on behalf of an enrollee by another person when calculating the enrollee\u2019s total contribution to an out-of-pocket maximum, deductible, copayment, coinsurance or other cost-sharing arrangement.\u201d This means that any \u201cdiscounts, vouchers, financial assistance or other out-of-pocket reduction payments\u201d used as part of an individual\u2019s pharmacy benefits are required to be counted towards the individual\u2019s deductible.<\/p>\n<p>However, the IRS has clarified that to maintain qualified HDHP status for HSA eligibility purposes, the plan is required to \u201cdisregard drug discounts and other manufacturers\u2019 and providers\u2019 discounts in determining if the minimum deductible for an HDHP has been satisfied and only allows amounts actually paid by the individual to be taken into account for that purpose.\u201d Therefore, HDHPs that comply with the new Oklahoma law will not be qualified HDHPs for HSA eligibility purposes.<\/p>\n<p>ERISA likely preempts the new Oklahoma law and, if preempted, would not apply to self-insured plans that are subject to ERISA. However, the law will apply to fully insured plans issued in the state of Oklahoma regardless of whether the plan is subject to ERISA. Therefore, fully insured plans issued in Oklahoma that provide pharmacy benefits likely cannot be considered qualified HDHPs, and participants of such plans likely will not be eligible to make HSA contributions. However, an individual is not required to be \u201cHSA eligible\u201d to take tax-free distributions from their HSA.
