SUMMARY:Family Medical Leave Act (FMLA) and Health Benefit Plans
DESCRIPTION:Employers subject to the Federal Family and Medical Leave Act (FMLA) must provide job-protected leaves of absence to covered workers\, including offering protections for health care and other benefits. Although many employers understand the job protection aspect of FMLA\, protecting and maintaining employee health care benefits during FMLA leave can be just as\, if not more\, challenging. During this one-hour refresher\, the Regulatory and Legislative Strategy team will be partnering with Brown & Brown’s Strategic Non-Medical Solutions Absence Consulting team to review and answer commonly asked questions\, such as: \n\nWhat employers are subject to FMLA?\nWhat employees are eligible for FMLA?\nUnder what circumstances can employees take job-protected FMLA leave?\nWhat are the job and group health plan protections provided under FMLA?\nHow does job-protected leave affect welfare benefits other than group health plans?\nWhat steps can an employer take to avoid administration pitfalls during and after an FMLA leave?

SUMMARY:Fringe Benefits: Compliance Considerations
DESCRIPTION:Under the Internal Revenue Code (IRC)\, all compensation and benefits received by an employee from their employer are considered taxable unless an exclusion applies. Many employers are aware that health benefits\, such as health insurance coverage\, can be provided to employees on a non-taxable basis\, but may not know that the IRS provides other avenues for employees to receive tax-exempt benefits in the form of “qualified fringe benefits.” \nFringe benefits are a category of compensation/benefits provided by employers to employees in addition to their regular wages. Examples of this may include assistance programs or other non-monetary benefits that in some cases qualify for favorable tax treatment under the IRC.\nAlthough many employers wish to offer these types of additional benefits to employees\, navigating the tax implications and potential requirements of these plans can be challenging. \nDuring this one-hour refresher\, the Regulatory and Legislative Strategy Group will review many considerations and address commonly asked questions related to some fringe benefits including life and disability plans\, commuter benefits\, lifestyle spending accounts (LSAs) and more. The team will also address funding arrangements for fringe benefits and their connection to ERISA and COBRA. \n
